  • LOSS OF PROFITS, REVENUE, OR DATA;
  • LOSS OF GOODWILL OR BUSINESS OPPORTUNITIES;
  • PERSONAL INJURY OR PROPERTY DAMAGE;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS;

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ANTHONY'S COAL FIRED PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

14. Indemnification

You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza and its officers, directors, shareholders, employees, agents, contractors, licensors, successors, and assigns from and against any and all claims, damages, losses, liabilities, suits, proceedings, demands, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

17. Dispute Resolution and Arbitration

17.1 Informal Resolution

Both parties agree to attempt to resolve the dispute informally for a period of thirty (30) days from the date of receipt of the dispute notice.

17.2 Binding Arbitration

You and Anthony's Coal Fired Pizza each agree that any dispute resolution proceedings shall be conducted only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action or proceeding. Both parties waive the right to a trial by jury and the right to participate in a class action.

17.3 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or other irreparable harm, without waiving the right to arbitrate all other disputes.

17.4 Small Claims Court

Either party may bring an individual action in a small claims court of competent jurisdiction, provided the dispute qualifies under the court's jurisdictional requirements and the claim remains in small claims court.

18. Term and Termination

These Terms shall remain in full force and effect for as long as you use the Site or Services. Anthony's Coal Fired Pizza reserves the right, in its sole discretion and without prior notice or liability, to:
